These Terms of Service ("Terms") govern your access to and use of Blendmaven's feed formulation platform and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and your agreement to these Terms will be treated as the agreement of the organization.

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate and current
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You may not share your account credentials or allow anyone else to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or modify any proprietary notices or labels
• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, or harm other users

The Service, including its software, design, text, graphics, and other content (excluding Your Content), is owned by Blendmaven and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

The Blendmaven name, logo, and related marks are trademarks of Blendmaven. You may not use these marks without our prior written permission.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• Feed formulas created using the Service will meet specific nutritional standards

YOU ACKNOWLEDGE THAT FEED FORMULATION INVOLVES PROFESSIONAL JUDGMENT AND THAT THE SERVICE IS A TOOL TO ASSIST, NOT REPLACE, PROFESSIONAL EXPERTISE. YOU ARE RESPONSIBLE FOR VERIFYING ALL FORMULATIONS AND RESULTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLENDMAVEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.

You agree to indemnify, defend, and hold harmless Blendmaven and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your Content
• Feed formulations created using the Service

You may terminate your account at any time by following the cancellation process in your account settings. Upon termination, your right to use the Service will immediately cease.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. We may also delete Your Content following termination, subject to our data retention policies.

Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

We reserve the right to modify or discontinue the Service at any time, with or without notice. We may also modify these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Blendmaven operates, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or violation of these Terms.
